Overview

Business success needs time, effort, and money. You make sure your product and services are the best and unique. But, seeing someone using your brand name is going to impact your brand reputation drastically. Your efforts will go into vain, which you don't want.

Most of the time, Trademark (TM) owners end up in prolonged litigation because they did not consider trademark registration for their business or brand name when the time was there.

Fortunately, the process of trademark registration in Delhi is simple. With just a few easy steps, you can make your brand name protected legally. Let's understand the steps in detail:

Step 1: Trademark Search

Many business entrepreneurs do not consider trademark search. You might think you have a unique brand name, but it is possible within a few weeks or months. Some other company ends up using it.

It gives you a distinct picture of whether your trademark is unique or not with a trademark search. Searching on time means you are preventing unforeseen events. So, getting the brand in the first place is a great way to save money and time.

Step 2: Filing Trademark Application in India

Once you know your logo or brand name has not been listed in the trademark list, you can consider registration. Firstly, file a trademark application form at the Trademark Office, India. The offices in India have located in Kolkata, Delhi, Chennai, and Mumbai. Fortunately, you can get the process done online. Once the application has filed, you will get an official receipt for future reference. You can even check your trademark status online.

Step 3: TM Examination

Once the application has filed, the examiner will look for any inconsistency. To check for any variance, it takes around 1 to 2 months. Your trademark might be accepted entirely, conditionally, or disapproved.

  • Once it is accepted, it has published in the 'Trademark Journal'.

  • If not accepted unconditionally, there are few conditions or some objection, then everything is mentioned in the report. One month has been given to fulfill the requirements.

Step 4: TM Publication

TM publication is a procedure that objects to the trademark registration, and they want to oppose it. If within four months, there is no opposition, the registration process has proceeded. If there is some problem, then the hearing is done to make the final decision.

Step 5: Registration Certificate

Once the application has proceeded, a registration certificate has been issued under the Trademark Office's seal.

Step 6: Trademark Renewal

Trademarks can be renewed after 10 years to protect your brand name or logo in this business world.
